Military Taxes By State

Question: Isn’t taxation to fund the military, for the good of all citizens, a classic example of socialism?
Isn’t the military a socialist institution? If it were not, it would be privately run and for hire. As it is, it’s run and owned by the state, payed for by the tax-payer… for the good of the country and all it’s citizens.
Canada has many socialist institutions that are profitable. So do many other countries. That has nothing to do with whether they’re socialist. The profits simply benefit the society.
Dan, that’s pure socialism. There are almost no examples of that on the planet. I’m talking about social Democracies like Holland, France, Canada, Sweden, etc. Pure socialism exists nowhere of importance.

Question: Is the Income Tax legal, and was the 16th Amendment ever ratified by Congress?
We are looking for historical evidence here folks! Quoting from the IRS website IS NOT EVIDENCE! Facts only, no quotes or opinions from IRS talking heads please.
Answer: This is actually a complex issue that is not as simple as whether or not the 16th amendment was ratified. I will try to lay out the various components of this debate in as clear and concise a way as possible, while remaining objective in my presentation.
1. I cannot get a clear answer on whether the 16th was ratified or not, some sources say that it was, others say that it wasn’t and still others claim that it was, but not legitimately. I won’t get any further into this aspect of the debate, since there is so much more to cover. For now, let us assume that it WAS.
2. Even if the 16th amendment WAS properly ratified, there is still the debate over whether it authorizes new taxes.
The Supreme Court, in the Brushaber and Stanton decisions of 1916, declare that the income tax, under the newly enacted 16th Amendment, does not create for the government any new power to tax.
However, lower courts have not always ruled in a way that is consistent with the Supreme Court ruling, namely, in situations where the jury fails to demand that the prosecution or the judge SHOW THEM the law that says the defendant is compelled to pay income tax. In those situations, the ruling can go against the defendant, but only due to a failure of the judge and jury to uphold justice according to the law. Moreover, upon inquiry, Sheldon Cohen (former IRS Commissioner and author of the Tax Code) claimed that Supreme Court decisions do not apply to the IRS tax code, a claim which flies in the face of the Constitution and the authority of the Supreme Court.
3. The word “income” is not defined even once in the IRS tax code, and if we refer to the definition of “income” as defined by the Constitution, we find that it is actually defined as “profit” or “gains,” not compensation for labor, which as the_divine_mrs_m pointed out, is actually more of a barter than a profit.
“Income within the meaning of the 16th Amendment and the Revenue Act means, gain … and, in such connection, gain means profit… proceeding from property severed from capital, however invested or employed and coming in, received or drawn by the taxpayer for his separate use, benefit and disposal.” – [Staples v. U.S., 21 F Supp 737 U.S. Dist. Ct. ED PA, 1937] –
Despite massive demonstrations and years of requests, the IRS has still failed to simply show citizens the law that requires them to pay income tax. That is not to say that you won’t be taken to court, and there is no guarantee that you will be able to defend yourself, even with the Supreme Court on your side.

NGC6205, you may be correct that the 16th was properly ratified, but you still fail to address the other two major components of this controversy, namely the Supreme Court rulings regarding the 16th amendment, and the legal definition of income. Moreover, despite the fact that you present a very good point about the credibility of ONE man, there are many other perhaps more credible sources, including former IRS agents, who agree with the claim that there is no law compelling a person to pay a tax on his income. Additionally, there are many individuals who have fought the income tax and won in court.

I will not waste my time responding to the information presented by DEANC1963. Despite your well-spokenness, sir, you have failed to cite a single article or statute that proves the legality of the income tax, and you get wildly off topic by talking about the philosophy of the founders towards taxation (which is not debated nor relevant in this discussion) and making unfair suppositions about the sources of the information cited by people who’ve questioned the legality of the income tax. You do not help your case by accusing legitimate sources of being “conspiracy theorists.” Frankly, such tactics only make you seem ignorant and dishonest.

Once again, if anyone can show me the law that compels a person to pay tax on his wages, or more recent Supreme Court rulings that overrule the ones I have cited, I will be very interested in seeing this information and more than willing to admit my mistake.
I would also be interested in seeing where in the Constitution, the IRS code or anywhere else in US law that “income” is defined as “wages or salary” as opposed to profit from a business or investment.
Until such a time as this information is presented, I have no choice but to stand by my conclusion that, while the 16th amendment may have been ratified (albeit under questionable circumstances) the federal income tax is still NOT legal.

I think we finally have a real discussion on our hands, and probably one which is well above the scope of the usual Yahoo Answers tripe. I am legitimately interested in seeing this debate through to a logical conclusion, as I do NOT claim to be more than an amateur and a novice regarding tax law, and all I ever wanted was to get to the bottom of this controversy for myself. I am certainly not prepared to dismiss any opposing point of view.
However, I can tell you right off the top of my head that this claim:
“No tax protestor has ever won a court case to avoid their income taxes, never.”
is wrong.

Well, now you’re debating semantics. I am not a lawyer. But if you tell me that no one ever won a court case over this, my immediate response is “gee, what about all those people who did?” Oh, well, they DID, but technically the court didn’t declare that they don’t have to pay income taxes in the future. Oh, sorry, my mistake, it just seemed to me like those who refused to pay the tax, were challenged in court, and WON, seemed to me like that would have been an example of someone winning a case to avoid their income taxes. What the IRS chooses to do after the fact is a separate issue, especially supposing the standard operating procedure of the IRS is illegal anyways, and I thought we were debating legality here.

Question: Where the heck is my 2008 tax return?
Ok here is the deal I filed on the 16th of Jan 2009. I received my Accepted by the Irs on the 19th and the refund cycle chart said it would be direct deposited on the 30th and on the Wheres my refund site it said I would have it by the 10th of Feb!!! So is anyone else having this problem or is something wrong with my return????
Answer: You filed your 2008 tax return. You are now demanding your tax REFUND. Due to a lot of things, the promises made are there to be broken. All reports are that deposits can be delayed as much as 3-4 weeks past the original promised date.
