Question: Are the following items being Tax-free allocations when settling with an employer on a separation package?

Allocation to legal expense, education expense, general damages, mental, distress, pain & suffering, human rights damages, job search expense, etc..?

Answer: Settlement damages for wrongful dismissal arising from your former employment are fully taxable in Canada, aside from an eligibility for an RRSP payment over and above the normal annual entitlement. The RRSP payment basically is $2,000 per year of service up to and ending in 1996. For years prior to 1989, where there was no pension or deferred profit sharing plan, a further $1,500 per year can be added. Punitive damage claims likely are taxable, as are mental distress claims.
