Question: Where can I file for a “Doing Business As” form (DBA)?

Hey guy,

I have no business license, and I don’t have a Tax ID, but I heard I can still file for a DBA form. My aim is to at least have a professional business name I can use when I fill out forms for affiliates, and other such business matters. I’m from NYC, where can I fill out a DBA form? And if I’m wrong about what I’ve said, please correct me.

Answer: In NY, dba certs are filed with the County Clerk’s office.

Question: Sales Tax?

Is it possible for State Board of Equalization to be able to track down sales of e-commerce store? I know that a lot of E-bay sellers dont report sales tax, but what about other online stores?




Answer: Is it possible? Yes. As another poster mentioned, pretty much anything can be tracked if someone’s keeping good enough records.

Is it legal? Depends. If you are selling goods over the internet to a state where you as a retailer have a physical connection, then you as the retailer are legally obliged to register as a seller with the state and to collect the sales or use tax. If you are selling out of state e.g. you live and work in California and are selling to a buyer in Washington, and sending the goods by mail, then you have no such obligation. The obligation in this case is on the buyer to report and pay the use tax. It varies from state to state, so I’m not going to source them all here, but the general description above applies to most states that have a sales tax.

Most people performing one-off sales are going to spend as much time collecting and filing sales tax on in-state sales as the out-of-state buyer is going to spend reporting and paying for the use tax – i.e. none whatsoever.

If you are running a business, or if this sale performs part of your income, and/or that revenue can be detected in an audit, then there is a risk that the BoE will pick up that sale, and want to know how it was accounted for.

Is it practical? As a generalisation, the states are quite concerned about the amount of revenue that they miss out on due to e-commerce sales. Many of them – California, by all accounts, is a good example – are pretty aggressive when it comes to getting their piece of the pie.

That said, obviously they’ll hit the entities they think they can get some money out of. If you’re selling your kids’ used football boots on eBay, I’m going to go out on a limb here and say that you’re probably not at risk if you don’t collect sales tax. On the other hand, if you’re making a living out of buying and selling on eBay, then your time may soon come.

Is it fair? That’s between you and your local government.

Question: How do I pay sales tax that I have collected from my small business in Rhode Island?

I have a small business run from my home. I sell retail items online and through catalogs. My website charges sales tax to people that live in certain states. I have contacted several places and no one seems to know the answer my question. They told me I dont need to do anything but I know that I am not supposed to keep the sales tax andI have no choice but to charge it. It is a very nominal amount but still not mine to keep.
Also, I did a fundraiser recently for a school which is tax exempt and I have no idea what to do with the tax exempt certificate. I didn’t have to pay any tax for the order but I am told by my supplier that I need to file the certificiate.
HELP!!!!!!!




Answer: On the tax exempt thing the person who sold you the items tax free gets a cert and in case of an audit shows that no tax was collected because you were tax exempt.
