Question: Is it illegal for states to tax non residents pension accounts?

I have lived in Nevada for 2 years and got a pension payment in 2010.
I moved out of California & i work for the same company for 10 yrs so when i transfered to Nevada my employer never updated my new state housing information.
So i did my state tax online & they say i have to pay $69 to California because i took out a retirement payment before the age of 59..
Is this illegal for them to take my money considering i have not lived in California for 2 yrs?

Answer: CA can tax your CA sourced pension up until the date that you moved to NV. The fact that an employer or account custodian failed to update their records is irrelevant. You might need to satisfy the FTB of the date that your domicile actually changed, but if the payout occurred after you left CA, they can’t tax it.

This is governed by Federal law that has been on the books since the Clinton administration.

Answer: I would love it…but there are plenty of Obama appointed hack judges and Clinton era ones who would stop it. And thanks to the fact of the last amnesty, the illegals have gained a foothold in the country. The amnestied ones can’t be removed now, and will make their reps vote against it.

I am a California resident if i purchase a new car in Oregon where there is no sales tax do i have to pay a sales tax when i register in California? Isn’t there a law or right against interstate taxes?
