How can i report someone that claimed my taxes w. out my authorization? I am an illinois recident but while i was in california in 2006 I tried to claim my taxes for 2004 and 2005. I went to a local place where a close friend of mine works as a supervisor. I told her what i was there for and she looked a little lost. She had told me that one of my aunts had gone there and claimed my taxes w/ a dependent to get more money. My friend (Dalia) is a friend of the family as well so she asked my aunt if I had authorized her and my aunt told her yes. So she did it w. no problem… my aunt had all my W-2s because I use to live w. her while I was working. She’ve received it in the mail and thats how she got to claim my taxes for 2004. I’m very new at this. To be honest I didnt started working till the year of “04″ so I need the most of your help.

Question: Is it illegal for states to tax non residents pension accounts?

I have lived in Nevada for 2 years and got a pension payment in 2010.
I moved out of California & i work for the same company for 10 yrs so when i transfered to Nevada my employer never updated my new state housing information.
So i did my state tax online & they say i have to pay $69 to California because i took out a retirement payment before the age of 59..
Is this illegal for them to take my money considering i have not lived in California for 2 yrs?

Answer: CA can tax your CA sourced pension up until the date that you moved to NV. The fact that an employer or account custodian failed to update their records is irrelevant. You might need to satisfy the FTB of the date that your domicile actually changed, but if the payout occurred after you left CA, they can’t tax it.

This is governed by Federal law that has been on the books since the Clinton administration.
