Question: 1099 – Business License?
I live in Temecula, California and I work as a manicurist. I earn commission with my job. Just recently, my Boss tells me to fill out a 1099 form and told me to obtain a Business License. Now, my question is, 1. why do i need a business license if I’m working under him? 2. He also told me that after i obtain a business license, if MY client (or whomever I’m working on) slip and fall, its my responsibilities, and if i injured them (make them bleed while cutting their cuticles) then that would be my responsibilities too. Is that true? I mean, I work for him, he’s the boss, it’s his shop, why do i need to obtain a business license and why am i reliable for all of this? Please help me out. I tried contacting the city of Temecula and they kept transferring my call around. I called the IRS and they told me it’s not their business if its not related to tax.
Answer: You are a subcontractor for him. You are like renting a booth from him. As far as the responsibility goes it is still all on him because he owns the building. Keep in mind too that you are responsible for all your FICA taxes.
