Question: Can someone recommend a good tax attorney in the Bay Area of California?

The IRS says my friend owes a large chunk of money from 1991 (including interest and penalties). He isn’t so sure. Thanks in advance for your help everyone!




Answer: This is not a tax attorney kind of issue. At least not yet. You need to know what the problem is before you start working on the solution. Finding out why there is a balance due then dealing with whether to pay it (because it is due) or show that it is not due or document the fact that you are unable to pay is what should be done first.

Question: Did the ’97annual $800 CA Franchise Tax Board tax apply to all enitities or just to registered w/Sec. of State

State of California claims that we owe $800 (Now $1983.58 with added int. and penalties) from 1997. Our enitity was not registerd with the CA Secretary of State during the 1997 tax year. Does the $800 annual tax apply only to registered entities, or to all entities?

State filed a lien against our Real Estate. State never answered our two 2005 replies to their Amnesty program.

WW2 Vet way below the poverty level. Will write/fax the State and see what settlement they will accept.
I only have a few hundred dollars and was going to use to buy suplements.

An individual in the State was waiting for my further
explanation but my restricted heart arteries and a minor stroke prevented me from answering.

Answer: I’m not an expert, but I did discuss the $800 minimum tax with an expert recently. It’s my understanding that the tax applies to anyone doing business in the state, whether registered or not.

Question: I need tax help! I have been working at my company for three years…

And I am moving to another state. They have asked me to become a consultant for them. I realize this means that I will have to set aside the money to pay my own taxes, as I have been told I will be issued a 1099 at the end of the year.
I will be living in RI, do I need a business lisence to do this? Do I need to register as a company in my own right? I will not be providing consultation for any other companies, and will be working for this company 40 hours per week.
I need some direction in a big way! Should I just go to a tax professional in RI and throw myself at their mercy? Anyone with some knowledge would be most appreciated.




Answer: This can be complicated.
First, have you been treated as an employee and received a W-2 for the past three years? If so, I think your employer is pushing the envelope with now treating you as a self employed consultant. Regardless……

You may have to register your business in the locality where you work. I am fairly sure that the State does not require that you register if you are conducting business as a sole proprietor. You can probably go to the state website to find that out.

Finally, you should seek the help of a tax professional in RI.

Question: First time home buyer: how to get interest payments back monthly instead of once a year?

Just about to buy my first home which is very exciting!
Since I’ll be be paying close to $3,000 in interest/$1,000 in real estate taxes a month and I would like to keep my monthly income as high as possible I would like to tweak the W-4 withholding allowance so less taxes are being withheld. There are a number of calculators on the internet, but none of them seem to be applicable specially for mortgage interest (and real estate taxes).

How can I go about this?

Answer: see your personal director where you work and fill out a new W-4 withholding form. There is a worksheet to help you figure out how much to withhold.

If I remember, each one is worth $25 less withheld and you can claim up to 99. However, remember, if you underestimate your tax withholding, the IRS can fine you.
