Question: Income tax for International students in UK?
Im a student from Sri Lanka and doing my final year,while studying Im doing my part time work as well(legally student can work up to 20 hrs /week) Im not sure as a student whether Ill be exempted from tax.Last week I got my pay slip from my total amount 82 pounds(I have worked 15 hrs,for two weeks) I have been deducted 17 pounds as an income tax,my tax code is BR.
My friend said I can claim that by filling the P46,if anyone know the legal issue please advice
Answer: As you are a foreigner, you have to establish your residency status before we know if you are entitled to British tax allowances. You can do this by downloading form P86 from www.hmrc.gov.uk/p86, completing it, and sending to tax office. I am not sure if Sri Lanka is part of the British Commonwealth (I think so, India is), and if it is, you will be OK.
If you have been in the UK since before the start of our tax year on 6th April 2008, you will also need to complete a form P91 to tell HMRC about your history of employment since you came here, even if it is only “full-time education”.
Form P46 may be relevant, but it won’t sort out your tax affairs by itself. Students are not exempt from British tax, despite the myths, and they get no extra tax breaks. The tax-free allowance for all people eligible is currently £6035 a year. Any tax refund to which you are entitled will be because of unused tax allowances.
If you are given the tax allowance on a cumulative basis after the submission of your forms, any refund due for this year will be made by employer with your wages. If there is any due prior to 5th April last, you will have to send documentation (forms P60/P45) to tax office, and claim it.
