Question: Canada child tax and income tax for seperated spouse?
Me and my spouse are separated and have 3 children. I have not been working this past year and I currently receive the canada child tax benefits for the 3 kids, he would like to put the kids as dependents on his income tax this year since he get’s taxed very heavily with his income. I always had the kids as my dependents though, if he put them on his income tax return now would that stop me from receiving child tax for the 3 kids since I did not claim them even though my income is very low and his is high? My mom thinks it would and the child tax would be calculated on his income then but I just wanted to clarify it.
Answer: If he is paying you child support then he can claim that on his taxes for a tax break. If he claims them as dependants and they do not live with him it is illegal, and yes the gov will send the child tax credit to him next year (in a reduced amount according to his income) and you will have to pay back the child tax credit for the year he is claiming. He is literally trying to say that the kids live with him and he is the sole supporter.If you are permanantly separated then go to a lawyer and arrange for maintenance. Unless you are very secure in just a verbal agreement with him, DON’T DO IT.
